This text constitutes a summary of the general terms and conditions, which are available on our website www.optimol-lubrication.com and upon request at our registered office at 1070 Brussels, Bollinckxstraat 43.
The recipient of this document acknowledges having been informed of the full general terms and conditions and accepts them.
- These general terms and conditions of sale take precedence over any purchasing conditions.
- Any modification or cancellation of an order can only be considered if communicated in writing before the products are dispatched. If the seller does not accept the modification or cancellation, any deposits made will not be refunded.
- Unless otherwise agreed, prices are net and exclusive of costs.
- Exceeding delivery times shall not entitle the buyer to damages, withholding, or cancellation of ongoing orders. The products travel at the expense and risk of the buyer who, in case of damage, loss, or shortage, must make a claim or objection with the responsible carriers.
- Any objection regarding visible defects or non-conformity of the delivered product with the ordered product must be made in writing within eight days after the arrival of the products, failing which it will be forfeited.
- The products are subject to a manufacturer's warranty against any manufacturing defects for a period of 2 years from the date of delivery. Excluded are defects and damages caused by natural wear and tear, external accidents, use or modification of the product not foreseen or specified by the seller, or lack of maintenance of the product.
- All invoices are payable upon receipt of the products or service delivery. Any unpaid amount on the due date specified on the invoice shall automatically incur late payment interest at an annual rate of 12%, calculated on a pro rata temporis basis per day of delay, from the day following the payment date indicated on the invoice until full payment is received. In case of default, forty-eight hours after an unsuccessful formal notice, the sale shall be automatically terminated at the discretion of the seller, who may request the return of the products, without prejudice to any other damages.
Any invoice collected by the dispute resolution service shall, in accordance with Article 1229 of the Civil Code, be subject to a non-reducible penalty clause increased by a fixed compensation set at 15% of the invoice amount, with a minimum of €40.
- Ownership of the sold products shall be suspended until full payment of their price by the customer.
- This contract is governed by Belgian law and subject to it. Any dispute shall be subject to the jurisdiction of the courts of Brussels.
